On inquiry, Jockey SU Lim, the rider of SHANGHAI CAPTAIN, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he failed to straighten his mount, SHANGHAI CAPTAIN, when it shifted in passing the 275M thereby causing TRIPLE ONE STAR to be checked.

In assessing the penalty, the Stewards took into consideration Jockey SU Lim’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) Malaysian race days with effect from 2 October 2023 and to expire on 15 October 2023, both dates inclusive. He was advised of his Right of Appeal.

At the conclusion of an inquiry, Jockey MM Firdaus, the rider of GOLDEN PEAK, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he shifted in near the 175M causing BRAVE WARRIOR to check.

In assessing the penalty, the Stewards took into consideration Jockey MM Firdaus’ guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) Malaysian race days with effect from 1 October 2023 and to expire on 14 October 2023, both dates inclusive. He was advised of his Right of Appeal.

At the conclusion of an inquiry, Jockey KP Lim, the rider of MYSTERIOUS CAPTAIN, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he shifted in approaching the 1050M and tightened several runners.

In assessing the penalty, the Stewards took into consideration Jockey KP Lim’s guilty plea, mitigating factors, good recent riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 2 October 2023 and to expire on 14 October 2023, both dates inclusive. He was advised of his Right of Appeal.

On inquiry, Jockey AK Lim, the rider of SAFE JOURNEY, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he shifted in at about the 175M mark and caused PURE PERFECTION to be restrained.

In assessing the penalty, the Stewards took into consideration Jockey AK Lim’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) Malaysian race days, to be deferred, with effect from 9 October 2023 and to expire on 21 October 2023, both dates inclusive. He was advised of his Right of Appeal.

On inquiry, Jockey SU Lim, the rider of PURE PERFECTION, was found guilty of a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he shifted in passing the 250M causing YINYANG to clip its heels and blunder badly.

In assessing the penalty, the Stewards took into consideration Jockey SU Lim’s mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) Malaysian race days, to be served consecutively with any other penalty, with effect from 16 October 2023 and to expire on 28 October 2023, both dates inclusive. He was advised of his Right of Appeal.

The Stewards, on Friday, 29 September 2023 at the Selangor Turf Club, concluded an inquiry into Jockey M Ewe’s riding of ROYAL FLUSH in the above race. Further evidence was taken from Jockey M Ewe, who did not present any further witnesses.

After considering the evidence and also reviewing the performance of ROYAL FLUSH, the Stewards found Jockey M Ewe guilty under MRA Rule 44(8) for failing to take all reasonable and permissible measures throughout the race to ensure that ROYAL FLUSH was given full opportunity of winning or of obtaining the best possible placing in that he had failed to ride the mare out in the straight from the 200M mark.

The Stewards took into consideration Jockey M Ewe’s riding record, mitigating factors and his submissions on penalty. He was disqualified for a period of one (1) year with immediate effect from 29 September 2023 and to expire on 28 September 2024, both dates inclusive. He was also fined RM50,000/- and advised of his Right of Appeal (3:35pm).

Jockey M Ewe subsequently exercised his Right of Appeal and applied for a Stay of Sentence. The Panel of Stewards considered the application for a stay which was not granted. The appeal hearing will be held at a date to be fixed.

Further, as Trainer HY Cheng was unable to attend the inquiry, he will be called at date to be advised for the continuation of the inquiry related to his evidence as the Trainer of ROYAL FLUSH.

RACE 3 (R0994) CLASS 5A – 1250M (LC A), SATURDAY, 16 SEPTEMBER 2023, SELANGOR TURF CLUB SEPTEMBER MEETING 2023

Jockey Z Khairil (BAGHDAD) who lodged an appeal against his suspension of three (3) months under MRA Rule 44(10), applied to withdraw his appeal on 26 September 2023. After consideration by the Appeal Panel, his application was acceded to, with RM2000/- of his deposit being forfeited. His suspension commenced on 27 September 2023 and to expire on 26 December 2023, both dates inclusive.

In assessing the penalty, the Stewards took into consideration App A Najib’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 30 September 2023 and to expire on 8 October 2023, both dates inclusive. He was advised of his Right of Appeal.

In assessing the penalty, the Stewards took into consideration App SN Shiva’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days, to be deferred, with effect from 24 September 2023 and to expire on 30 September 2023, both dates inclusive. He was advised of his Right of Appeal. Further, Jockey WW Cheah (BINTANG TIMOR) was reprimanded for failing to straighten more readily thus exasperating the incident.

The Stewards inquired into Jockey Z Khairil’s riding of BAGHDAD in this race. Evidence was taken from Jockey Z Khairil and Trainer NM Selvan, the rider and trainer of BAGHDAD respectively.

After considering the evidence and also reviewing the performance of BAGHDAD, Jockey Z Khairil pleaded guilty to a charge under MRA Rule 44(10) for failing to ride to the satisfaction of the Stewards. The particulars of the charge being that although instructed that BAGHDAD be ridden in its customary “on pace” position that he had restrained the gelding shortly after the start and he had failed to keep up with the pace whereby BAGHDAD was in a mid-to-rearward position until straightening, thereby diminishing its chances.

The Stewards took into consideration Jockey MM Z Khairil’s guilty plea, riding record, mitigating factors and his submissions on penalty. He was suspended from riding in races for a period of three (3) months with effect from 18 September 2023 and to expire on 17 December 2023, both dates inclusive. He was advised of his Right of Appeal.

Trainer NM Selvan, the Trainer of BAGHDAD, was advised by the Stewards that they had serious concerns related to the fact the on four (4) occasions, they had questioned the running and handling of his horses with two (2) of those occasions resulting in the suspension of riders under serious charges. He was advised that it was expected that all his runners must be ridden so as to be fully tested and should there be further occurrences of issues of question, that a report would be made to the Committee of the SLTC related to the matter.

On inquiry, Jockey WW Cheah, the rider of I’M SMART GREY, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he had shifted in, crowding RAHOTU which had to be restrained near the 950M.

In assessing the penalty, the Stewards took into consideration Jockey WW Cheah’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) Malaysian race days, to be deferred, with effect from 24 September 2023 and to expire on 1 October 2023, both dates inclusive. He was advised of his Right of Appeal.

The Stewards concluded an inquiry into the presence of STR H Bukhari being attendant at the stables on the morning of 27 August 2023.

After taking initial evidence from two (2) Trainers, the inquiry was adjourned to allow for the results of samples taken for a runner, from that stable to be advised.

Whilst Stewards considered no nefarious act had been perpetrated, STR H Bukhari was reprimanded for being in the stables during the period of SLTC imposed pre-race curfew and advised that should he offend again that he risks his license being suspended.

AMENDMENT

RACE 3 (R0946) CLASS 5A – 1200M (LC A4), SUNDAY, 3 SEPTEMBER 2023, SELANGOR TURF CLUB SEPTEMBER MEETING 2023

On inquiry, App I Fikri, the rider of STARDICE, in the presence of his Employing Trainer, L Moy, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he allowed his mount to shift in causing STAY THE COURSE to check.

In assessing the penalty, the Stewards took into consideration App I Fikri’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) SLTC race days with effect from 4 September 2023 and to expire on 17 September 2023, both dates inclusive. He was advised of his Right of Appeal.

Further, it had backed off and had shortened its stride. He had then been crossed and momentarily steadied. He was at a loss to explain why the gelding had acted in his manner.
4	APIS (E Ferreira)	Jumped outwards at the start, striking the gate with rider dropping his whip. Shifted in causing runner to steady near the 950M. The Stewards inquired into the rider’s riding over the concluding stages when whipless. *(See Report)

Jockey E Ferreira explained that after dropping his whip at the start, when in a prominent position near the 300M, he had removed his cloth cap and used it on four (4) occasions in a waving manner in an endeavour to encourage the horse to perform. He advised that this was not uncommon in his home country of Brazil. Whilst accepting his explanation, the Stewards did not apply a fine related to the drop whip given that he had struck the barrier on exiting, however, warned Jockey E Ferreira that he is not permitted, in future, to use any part of his apparel and use it in a manner to goad this horse given that nothwithstanding other issues, the waving of an item such as a cloth cap may distract or frighten other runners.

When questioned regarding the performance of THUNDERGOD, Trainer S Hamilton advised that today’s distance was considerably shorter than she wished for the gelding as its best form was around a mile and as such she was not surprised that THUNDERGOD was in a rearward position early and that it ran home strongly.

Jockey SU Lim confirmed that he had been advised that THUNDERGOD would be beaten for pace at the 1200M but had ridden the gelding with significant vigour throughout as it was inclined to “drop off” and in the straight, it had made good ground under hard riding.

The Stewards accepted and noted the explanations, however, advised Trainer S Hamilton that she should endeavor to place her horses so as to be best suited by distance.

On inquiry, App R Nuqman, the rider of SMOOTH OPERATOR, in the presence of his Acting Employing Trainer, M Sukri, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he allowed his mount to shift in whilst continuing to use his whip causing GURNEY DRIVE to check at the 225M.

In assessing the penalty, the Stewards took into consideration App R Nuqman’s guilty plea, mitigating factors, recent poor riding record and his submissions on penalty. He was suspended from riding in races for a period of four (4) Malaysian race days, 4 September 2023 and to expire on 17 September 2023, both dates inclusive. He was advised of his Right of Appeal.

9	SHANG CHI (App AB Riduan)	The saddle slipped backwards near the 1000M, then slipped sideways at about the 150M with the Apprentice becoming unbalanced in the final 3 strides.

When questioned regarding the performance of MOONGATE LIGHT, Trainer R Lines advised the he had instructed the gelding to be ridden forward or even lead, if able to do so with no pressure. Although from its outside gate, he considered this task could be difficult.

App M Seelan stated that he had pushed MOONGATE LIGHT hard from the start but it had shown sufficient pace to be in a prominent position, and that although he had slapped the gelding several times, it had failed to improve its position in the straight. It was evident from the patrol film that the apprentice had ridden to the level of his vigorous from the start but that the gelding had failed to accelerate quickly to attain a leading position. He was advised, however, that he must endeavor to improve his position mid-race when in similar circumstances.

He was advised that under similar circumstances in future, he would be expected to ride more diligently and not to simply travel wide.

On inquiry, App A Suriya (NORTHERN KNIGHT) pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he used his whip shortly after the start thereby allowing it to shift in, crowding M ELEVEN onto ASIAN TIGER and LET’S COME ON BABY.

In assessing the penalty, the Stewards took into consideration App A Suriya’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days, to be deferred, with effect from 28 August 2023 and to expire on 9 September 2023, both dates inclusive. He was advised of his Right of Appeal.

RACE 11 (R847) Class 5 – 1200M (A sc), SUNDAY, 6 AUGUST 2023, SELANGOR TURF CLUB AUGUST MEETING 2023

The Stewards, on Thursday, 10 August 2023, inquired into running and handling of QUASAR in the above race. Evidence was taken from Jockey Z Khairil and Trainer NM Selvan, the rider and trainer of QUASAR respectively.

Trainer NM Selvan stated that he had instructed that QUASAR be ridden in a midfield position as was customary over the 1200M. Whilst he believed the gelding was best suited by racing on a softer track, he was comfortable with the state of the track as being suitable.

Jockey Z Khairil confirmed the instructions and advised that after jumping well, he had been in a nice position midfield, given that the leaders had gone very hard. Running to the 800M turn, he had been outside PACIFIC ARMANI (App R Nuqman) (placed second) and in advance of MARTIN VJ (App A Suriya) (winner) when he attempted to take up a better position closer to the fence but had received an appeal from App A Suriya who he believed was being crowded slightly. He had thus stayed in his three (3) wide position until straightening where he had struck QUASAR back handed on two (2) occasions. He had then ridden in his consistent manner using the whip on numerous occasions. He was of the opinion QUASAR had neither stopped nor progressed finishing a well beaten seventh (7^th).

The Stewards advised Jockey Z Khairil that they had concerns related to his true purpose when he had remained in three (3) wide position early in the race. He was advised that he must ride every mount in a purposeful and diligent manner.

Trainer NM Selvan was advised that it was expected that QUASAR be ridden in a similar fashion at its next starts.

RACE 10 (R846) Open Maiden – 1200M (A sc), SUNDAY, 6 AUGUST 2023, SELANGOR TURF CLUB AUGUST MEETING 2023

In review of races from 5^th and 6^th August 2023, the Stewards reprimanded Jockey KP Lim for continuing to use his whip on MAGIC TURBO in the above race, when the gelding was clearly winning.

Pursuant to MRA Rule 149(1)(h), the Appeal Panel acceded to his request and his deposit shall be forfeited. His suspension commenced on 16 August 2023 and to expire on 15 February 2024, both dates inclusive.

When questioned regarding the performance of READY TO SEVENLUCK, Jockey S Ruzaini stated that he intended to ride the gelding on the pace however, after being bumped heavily at the start, he found himself rearward, where it had commenced to race fiercely and was striding onto the heels of runners. Due to the slow pace of the race, he had elected, for safety reasons, to take the gelding wide at about the 1150M but had been unable to secure a better position closer to the fence as horses improved on his inside until straightening.

At the conclusion of an inquiry, App M Lukman (ARAGON PEGASUS) in the presence of his Employing Trainer, WC Lim, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he shifted in when insufficiently clear.
