Rider reported the gelding stumbled on several occasions mid-race. Vet inspection: Respiratory Distress  – 1000M/vet (1 month embargo)

On inquiry, Jockey S Salee, the rider of STARDICE, pleaded guilty to a charge under MRA Rule 44(10) for failing to ride to the satisfaction of the Stewards in terms of the veracity of his whip use. In assessing the penalty, the Stewards took into consideration Jockey S Salee’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period two (2) months with effect from 10 April 2023 and to expire on 9 June 2023, both dates inclusive. He was advised of his Right of Appeal.

The Stewards inquired into App A Nazir’s riding of GAIN ECLIPSE and after considering the evidence, they believed they could not substantiate a charge under the Rules, given he had to restrain prophylactically near the 200M. App A Nazir was warned that he must ensure that he rides all mounts so as to be fully tested.

On inquiry, App A Nazir, the rider of FANTASTIC ECLIPSE (placed fifth), in the presence of his Employing Trainer, F Maynard, pleaded guilty to a charge under MRA Rule 44(6) in that he failed to ride his horse out to the end of the race.

In assessing the penalty, the Stewards took into consideration App A Nazir’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) Malaysian race days with effect from 10 April 2023 and to expire on 22 April 2023, both dates inclusive. He was advised of his Right of Appeal.

On inquiry, Jockey S Salee, the rider of JIMMY ZAC, pleaded guilty to a charge under MRA Rule 44(10) for failing to ride to the satisfaction of the Stewards related to the veracity of his whip use.

In assessing the penalty, the Stewards took into consideration Jockey S Salee’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period two (2) months, to be served accumulatively with any other suspension, with effect from 10 June 2023 and to expire on 9 August 2023, both dates inclusive. He was advised of his Right of Appeal.

Bumped and then crowded at the start, losing ground, and raced fiercely in the middle stages.

The Stewards inquired into the running and handling of HAPPY THIRTYNINE. Evidence was taken from App A Suriya (HAPPY THIRTYNINE) and Mr Nagarajan a/l Supromaniam, Trainer MP Thwaites’ representative. 

App A Suriya, the rider of HAPPY THIRTYNINE, was found guilty of a charge under MRA Rule 44(10) for failing to ride to the satisfaction of the Stewards. The particulars of the charge being:

  1. He travelled wide from the 800M to the 400M with no attempt to demonstrate that he was trying to get closer to the rail; and

  2. He restrained HAPPY THIRTYNINE duly at the turn into the straight, thereafter he allowed the gelding to shift wide in the straight. 

In assessing the penalty, the Stewards took into consideration App A Suriya’s mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) months with effect from 10 April 2023 and to expire on 9 June 2023, both dates inclusive. He was advised of his Right of Appeal.

On inquiry, Jockey V Espindola, the rider of EL MACHO, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he shifted in, thereby crossing CRAYON SHIN-TAT which shifted in, crowding ICHIKA BACHIKA  which in turn tightened AUSSIE EAGLE with both horses being restrained.

In assessing the penalty, the Stewards took into consideration Jockey V Espindola’s guilty plea and good riding record. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 10 April 2023 and to expire on 16 April 2023, both dates inclusive. He was advised of his Right of Appeal.

On inquiry, App WW Cheah, the rider of EMPHATIC, in the presence of his Employing Trainer, R Lines, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that approaching the 900M, he shifted in, crowding MELTING POINT which in turn tightened CHOCANTE which buffeted with NO REGRETS causing that horse to be restrained and lose considerable ground.

In assessing the penalty, the Stewards took into consideration App WW Cheah’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days, to be deferred, with effect from 10 April 2023 and to expire on 16 April 2023, both dates inclusive. He was advised of his Right of Appeal.

Jockey MM Firdaus later reported that whilst being loaded, he hit his right knee on the right gate.

Jockey MM Firdaus was examined by the Club Doctor who found him to have an abrasion to his right knee as a result of the incident in Race 3 and subsequently stood him down from his riding engagement for his remainder ride.

Trainer EP Tan and App S Shazmin were questioned regarding the riding of MOMENT OF JUSTICE. Trainer EP Tan said that he had instructed the horse to be ridden from mid-to-back position as it was its normal racing pattern. App S Shazmin confirmed those instructions but advised the gelding had shown no response on his riding and niggling, and he had attempted to improve his riding mid-race. Further, he was impeded and unable to secure clear passage in the straight which compounded when a gap had closed at the 200M. He further stated that this was his normal level of vigour albeit that it had been curtailed due to being impeded in the straight. The Stewards advised App S Shazmin that they were dissatisfied with his level of vigour, however, giving the elements of the race, they did not believe they could substantiate a charge in terms of the Rules.

On inquiry, Jockey KC Tham, the rider of UNDER OATH, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding UNDER OATH, he allowed his horse to continue to shift in causing MYSTERIOUS CAPTAIN to be checked from his heels.

In assessing the penalty, the Stewards took into consideration Jockey KC Tham’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) Malaysian race days with effect from 3 April 2023 and to expire on 15 April 2023, both dates inclusive. He was advised of his Right of Appeal.

He was of the opinion that GLOBAL ARMY had got a soft lead although he had instructed the mare to be ridden close to the pace from its outside barrier and was further advantaged by a drop-in-class and again when claiming 3kgs.

Further veterinary clarification and examination on 21 March 2023 revealed that O’REILLY BAY was diagnosed, on endoscopy, with Respiratory Distress (not EIPH as reported previously) and there were no visible bleeding from the nostrils. O’REILLY BAY will be required to pass a 1000M/Vet test (1 month embargo) before being declared to race again.

On inquiry, Jockey R Rueven, the rider of BIG BAD MAMA, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he shifted in when insufficiently clear of DOCTOR GINGER causing that horse to be restrained, losing ground. BLACK QUAIL also had to be restrained in this incident.

In assessing the penalty, the Stewards took into consideration Jockey R Rueven’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 20 March 2023 and to expire on 26 March 2023, both dates inclusive. He was advised of his Right of Appeal.

The Stewards inquired as to the reason why FORSA ECLIPSE had not led. Trainer F Maynard advised that he had instructed that FORSA ECLIPSE to be ridden in a forward manner but not to be locked in a speed battle. He was very satisfied that App A Nazir had been able to get the gelding to settle early in the race and be in a positon of following the leader. Also it had been taken outwards on straightening but had failed to run on. App A Nazir confirmed the instructions and advised that FORSA ECLIPSE had settled for him easily and he was comfortable with the positioning and the fact that the gelding was travelling well within close proximity of the lead. The Stewards noted the explanations.

On inquiry, App R Nuqman (ANSU), in the presence of his Employing Trainer, BT Lim, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he continued to ride his mount out when shifting outwards from the 200M, causing SELANGOR STAR to be carried outwards and TOP GUN to be carried outwards and  clipping the heels of TRINITY GRACE, thereby dipping.

In assessing the penalty, the Stewards took into consideration App R Nuqman’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) Malaysian race days, to be deferred, with effect from 27 March 2023 and to expire on 8 April 2023, both dates inclusive. He was advised of his Right of Appeal.

On inquiry, App A Nazir (FANTASTIC ECLIPSE), in the presence of his Employing Trainer, F Maynard, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) for shifting in near the 800M, crowding GENERATION M which in turn tightened ACE’S WILD causing that horse to be buffeted and lose ground.

In assessing the penalty, the Stewards took into consideration App A Nazir’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 20 March 2023 and to expire on 26 March 2023, both dates inclusive. He was advised of his Right of Appeal.

A subsequent veterinary examination of BATTLESTAR revealed the gelding was lame off fore and as such will be required to pass a 1000M/vet (3 weeks embargo) test before being declared to race again.

The Stewards, 5 March 2023 (Sunday), concluded an inquiry into Jockey S Ruzaini’s riding of INHERIT in this race. Further evidence was taken from Jockey S Ruzaini and Trainer HY Cheng, the rider and trainer of INHERIT respectively. 

After considering the evidence and also reviewing the performance of INHERIT, the Stewards found Jockey S Ruzaini guilty to a charge under MRA Rule 44(10) for failing to ride to the satisfaction of the Stewards. The particulars of the charge being that the manner in which he rode with regards to his arm action, in particular not allowing his horse sufficient room with his left arm to be able to gallop properly. 

The Stewards took into consideration Jockey S Ruzaini’s riding record, mitigating factors and his submissions on penalty. He was suspended from riding in races for a period of three (3) months, to be served cumulatively related to any other penalty. He was also fined RM20,000/- and advised of his Right of Appeal. 


 RACE 9 (R217) CLASS 5a – 1200M (C4 sc), SATURDAY, 25 FEBRUARY 2023, SELANGOR TURF CLUB FEBRUARY MEETING 2023 

The Stewards, on 5 March 2023 (Sunday), inquired into App R Nuqman’s riding of DIAMOND SET in the above race. Evidence was taken from App R Nuqman, in the presence of his Employing Trainer, BT Lim and Trainer EP Tan, the Trainer of DIAMOND SET.

It was established that given its wide draw, the intention was for DIAMOND SET to be ridden off the pace. App R Nuqman had positioned the gelding behind the leaders as he had not wished for it to travel wide. It was evident also that he had put DIAMOND SET under pressure near the 600M when applying the whip. The Stewards noted that the gelding was inclined to lay inwards in the straight, requiring him to straighten on two (2) occasions.

 After considering this evident, the Stewards took no further action.


RACE 4 (R212) CLASS 4a – 1300M (C4 lc), SATURDAY, 25 FEBRUARY 2023, SELANGOR TURF CLUB FEBRUARY MEETING 2023 

Jockey S Ruzaini (EMPHATIC) subsequently exercised his Right of Appeal and applied for a Stay of Sentence. The Stewards considered the application for a stay which was granted. The appeal hearing will be held at a date to be fixed.


RACE 5 (R213) CLASS 4b – 1300M (C4 lc), SATURDAY, 25 FEBRUARY 2023, SELANGOR TURF CLUB FEBRUARY MEETING 2023 

Following review of race videos, Jockey L De Souza (MERCURIAL TURN) was reprimanded for excessive use of the whip, this was in furtherance to the censure he received related to looking around in the final stages.


RACE 12 (R220) CLASS 5b – 1200M (C4 sc), SATURDAY, 25 FEBRUARY 2023, SELANGOR TURF CLUB FEBRUARY MEETING 2023 

Trainer S Hamilton advised that MARCUS ANTONIUS (S Salee) which finished 8th, was racing first-up for 9 months, had pulled up slightly short in its action. She would have the gelding fully vetted and present the finding to the Stewards before being entered to race again.


RACE 4 (R224) Class 4a – 1300M (C4 lc), SUNDAY, 26 FEBRUARY 2023, SELANGOR TURF CLUB FEBRUARY MEETING 2023

Trainer S Dunderdale advised that he was disappointed with SUSPICIOUS MIND (J Low) performance in running 8th, suggesting only that being trapped wide from its outside barrier after being bumped heavily on jumping (see Stewards’ Report), had taken its toll on the gelding. Further, that SUSPICIOUS MIND was racing in a more experienced Class 4 field as opposed to all its previous Maiden performances.  As SUSPICIOUS MIND had pulled up well, it was his intention to continue its training regime but advised that it would not start the gelding for approximately three weeks.


RACE 12 (R232) Class 5b – 1200M (C4 sc), SUNDAY, 26 FEBRUARY 2023, SELANGOR TURF CLUB FEBRUARY MEETING 2023

Assistant Trainer Nagarajan a/l Supromaniam advised that SUPER LINE (App R Nuqman) had pulled up well after finishing 8th beaten 7.5 lengths. He believed the impediment (See Stewards’ Report) mid-raced, after which SUPER LINE was then obliged to race wide, had affected the gelding’s performance. He intended to continue its training regime and would not start it in a race for approximately three weeks.

The Stewards questioned App S Sia, in the presence of his Employing Trainer, R Lines. Trainer R Lines stated that he had instructed for READY TO SEVENLUCK to be ridden forward and hopefully would be able to secure an easy lead. The gelding was renowned for its recalcitrant manner and he was comfortable that App S Sia had been able to get the gelding to jump well and lead easily. App S Sia stated that READY TO SEVENLUCK had jumped well, given its previous poor stall history and he had found himself leading easily. He had not urged the gelding but after travelling well in stride, had attempted to steady READY TO SEVENLUCK but the gelding had raced very strongly. He was aware of the margin he was leading and had taken a second hold near the 1300M but was unable to restrain the gelding.

In considering this, the Stewards accepted the explanation, however, advised App S Sia that in similar circumstances, he should attempt some alternative strategies in riding his horses to secure an even pace.

Jockey HS Gill and App S Shazmin were both examined by the Club Doctor who stood them down from their riding engagements for the remainder of the races today.

Objections were lodged by Trainer S Dunderdale, the Trainer of SEMANTAN PRINCE (App T Ammar), placed fourth, against TRINITY GENERAL (KC Tham), being declared the winner, and GOLDEN FLAME (App R Nuqman), placed third, alleging interference over the final stages. The Panel of Stewards dismissed the objections.

A Stewards’ objection was lodged under the provisions of MRA Rule 124(3) on behalf of GOLDEN FLAME (App R Nuqman), placed third, against TRINITY GENERAL (KC Tham), being declared the winner, alleging interference over the final stages, given that both horses were trained by Trainer KC Tiang. The Panel of Stewards did not uphold the objection.

On inquiry, Jockey KC Tham, the rider of TRINITY GENERAL, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that over the final 50M, TRINITY GENERAL (KC Tham) was permitted to veer out quickly and cannoned into GOLDEN FLAME (App R Nuqman) which in turn shifted ground, bumping heavily with SEMANTAN PRINCE (App T Ammar). 

In assessing the penalty, the Stewards took into consideration Jockey KC Tham’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days, to be deferred, with effect from 6 March 2023 and to expire on 12 March 2023, both dates inclusive. He was advised of his Right of Appeal.

 The Stewards, today, inquired into Jockey S Ruzaini’s riding of EMPHATIC in this race. Evidence was taken from Jockey S Ruzaini and Trainer R Lines, the rider and trainer of EMPHATIC respectively. 

After considering the evidence and also reviewing the performance of EMPHATIC, the Stewards found Jockey S Ruzaini guilty of a charge under MRA Rule 44(10) for failing to ride to the satisfaction of the Stewards. The particulars of the charge being that between the 1000M and the 700M, he remained in a wide position when he was able to take up an inner position to benefit EMPHATIC. 

The Stewards took into consideration Jockey S Ruzaini’s riding record, mitigating factors and his submissions on penalty. He was suspended from riding in races for a period of two (2) months, to be deferred, with effect from 6 March 2023 and to expire on 5 May 2023, both dates inclusive. He was advised of his Right of Appeal.

After considering the evidence and also reviewing the performance of INHERIT, the Stewards charged Jockey S Ruzaini under MRA Rule 44(10) for failing to ride to the satisfaction of the Stewards. The particulars of the charge being that the manner in which he rode with regards to his arm action, in particular not allowing his horse sufficient room with his left arm to be able to gallop properly.

Jockey S Ruzaini pleaded not guilty to this charge and was permitted an adjournment to present further witnesses.

At the conclusion of an inquiry, Jockey M Ewe (FANTASTIC ECLIPSE) pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) for shifting in approaching the 900M causing several horses to check and to be restrained.

In assessing the penalty, the Stewards took into consideration Jockey M Ewe’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) Malaysian race days with effect from 27 February 2023 and to expire on 11 March 2023, both dates inclusive. He was advised of his Right of Appeal.

TRINITY REVIVAL

(V Espindola)

Rider reprimanded for failing to ride out to the end of the race albeit that he maintained (short-head) its fourth position.

Jockey R Rueven (SING DARCI) was examined by the Club Doctor who subsequently stood him down from his riding engagement for the remainder of the races today, and was subsequently taken to the hospital for further observation.

After this race, Trainer M Sukri was questioned as to the procedure adopted in the unsaddling of FARDUS (Y Aify). He advised that FARDUS is a particularly fractious horse and his Syces had unsaddled the horse when on the move, and subsequently the equipment had ended up being discarded on the ground, in the absence of its rider, Jockey Y Aify.

Whilst the Stewards are aware of the horse’s manners, Trainer M Sukri was warned that he must ensure that his Syces exercised proper control and diligence when assisting a rider to unsaddle a horse, so as to ensure integrity of weight carried.

The Stewards questioned Trainer MW Teh as to why he was late in presenting LUPIN in the paddock. It was confirmed that he had to substitute a girth on two (2) occasions and this delayed his saddling, however, Trainer MW Teh was advised that he ought to have his horses prepared which included bandaging prior to it being saddled.

Upon investigation, the Stewards established that D’GREAT OCEAN was presented with shoes which were worn in the toe region. Trainer KC Tiang (D’GREAT OCEAN) was fined RM1000/- under MRA Rule 35(1) for presenting D’GREAT OCEAN not properly shod.

App M Lukman (WHY NOT) was examined by the Club Doctor who subsequently stood him down from his riding engagement for his remainder ride.

An objection was lodged by App R Nuqman (KUBERA’S CHIEF), placed fourth, against SIMLONG BEACH (S Salee), placed third, alleging interference at about the 800M. The Panel of Stewards upheld the objection and amended the placing to:

2nd – I AM MIDAS (M Ewe)

3rd – KUBERA’S CHIEF (App R Nuqman)

4th – SIMLONG BEACH (S Salee)

At the conclusion of an inquiry, Jockey S Salee, the rider of SIMLONG BEACH, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he shifted in at about the 800M mark causing KUBERA’S CHIEF to check severely.

In assessing the penalty, the Stewards took into consideration Jockey S Salee’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of four (4) Malaysian race days with effect from 6 February 2023 and to expire on 19 February 2023, both dates inclusive. He was advised of his Right of Appeal.
