At the conclusion of an inquiry, Jockey R Shafiq, the rider of SUPER WHIRLWIND, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding SUPER WHIRLWIND at approximately the 250M in this race, he failed to ensure he did not cause interference to PROPLAYER at approximately the 250M mark.

In assessing the penalty, the Stewards took into consideration Jockey R Shafiq’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of one (1) Malaysian race day with effect from 22 January 2024 and to expire on 28 January 2024, both dates inclusive. He was also fined RM1,500/- and advised of his Right of Appeal.

At the conclusion of an inquiry, App A Nazir, the rider of OTTAWA, in the presence of his Employing Trainer, F Maynard, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding OTTAWA in this race, he failed to ensure he did not cause interference to ALEXANDER and PONTIANAK at approximately the 1100M.

In assessing the penalty, the Stewards took into consideration App A Nazir’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 22 January 2024 and to expire on 28 January 2024, both dates inclusive. He was advised of his Right of Appeal.

GENERAL REPORT(S) – SLTC

APPEAL BY JOCKEY MARK EWE JUN HAA (MARK EWE) AGAINST THE DISQUALIFICATION OF ONE (1) YEAR AND FINE OF RM50,000/- FOR CONTRAVENTION OF MRA RULE 44(8) IMPOSED BY THE PANEL OF STEWARDS RELATED TO HIS RIDING OF RACEHORSE “ROYAL FLUSH” IN RACE 4 (R1040) ON SUNDAY, 24 SEPTEMBER 2023 AT THE SELANGOR TURF CLUB SEPTEMBER MEETING 2023

The Selangor Turf Club Appeal Panel heard the above appeal on Saturday, 20 January 2024.

After considering submissions from Jockey Mark Ewe and the Chief Stipendiary Steward, the Appeal Panel upheld the appeal in part, against the conviction under MRA Rule 44(8). On the issue of penalty, they ratified the disqualification of one (1) year but reduced the fine to RM20,000/-. The deposit was ordered to be refunded.

RACE 2 (R1356) CLASS 5 A – 1400M (LC C4), SATURDAY, 23 DECEMBER 2023, SELANGOR TURF CLUB DECEMBER MEETING 2023

The Stewards, on Friday, 19 January 2024 at SLTC, concluded an inquiry into the riding of KING OF GLORY and took evidence from App M Seelan, the rider of KING OF GLORY, in the presence of his Employing Trainer, R Lines.

After reviewing the films of the incident and considering the evidence tendered, the Stewards decided to take no further action.

RACE 4 (R0039) CLASS 4 A – 1400M (LC A4), SUNDAY, 14 JANUARY 2024, SELANGOR TURF CLUB JANUARY MEETING 2024

The Stewards, on Friday, 19 January 2024 at SLTC, concluded an inquiry into the riding of TAU KEH SOH and took evidence from App A Nazir, the rider of TAU KEH SOH in the presence of his Employing Trainer, F Maynard.

After reviewing the films of the incident and considering the evidence tendered, the Stewards decided to take no further action.

App S Shazmin (AUSSIE EAGLE) was examined by the Club Doctor who subsequently stood him down from his riding engagements for the remainder of the races today.

At the conclusion of an inquiry, App SN Shiva, the rider of STARHARMONY, in the presence of his Employing Trainer’s representative, Trainer M Sukri, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding STARHARMONY in this race, he failed to ensure that he did not cause interference to EL MACHO (SU Lim), GASSUR (R Shafiq), UPTOWN GIRL (App A Azizi), ORDOS LEGEND (J De Souza) and ELISE (App A Nazir) at approximately the 1300M mark.

In assessing the penalty, the Stewards took into consideration App SN Shiva’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 15 January 2024 and to expire on 21 January 2024, both dates inclusive. He was advised of his Right of Appeal.

APPEAL BY JOCKEY WEI WEN CHEAH (WW CHEAH) AGAINST THE SUSPENSION OF FIVE (5) MALAYSIAN RACE DAYS FOR CONTRAVENTION OF MRA RULE 44(9)(a)(ii) IMPOSED BY THE PANEL OF STEWARDS RELATED TO HIS RIDING OF RACEHORSE “NEW GARDEN” IN RACE 2 (R1365) ON SUNDAY, 24 DECEMBER 2023 AT THE SELANGOR TURF CLUB DECEMBER MEETING 2023

The Selangor Turf Club Appeal Panel heard the above appeal on Thursday, 11 January 2024.

After considering submissions from Jockey WW Cheah, Trainer R Lines, App R Nuqman and the Chief Stipendiary Steward, the Appeal Panel allowed the appeal against the conviction under MRA Rule 44(9)(a)(ii). The deposit was ordered to be refunded.

In respect of the above matters, Jockey WW Cheah who has served part of his suspension (3 Malaysian race days) already, has applied for the remainder of the suspensions incurred, 5 Malaysian race days to be converted to a fine. The Stewards, after considering the matter, accepted Jockey WW Cheah’s application and converted his remaining suspension to a RM7500/- fine.

Consequently, Jockey WW Cheah is now free of embargo and his official suspension dates in respect of Race 5 above, are amended to 31 December 2023 to 9 January 2024, both dates inclusive.

Jockey S Ruzaini was fined RM500/- for negligence under MRA Rule 152(5)(a) for smoking in the Jockeys’ Room.

Trainer V Sivan was fined RM250/- for negligence under MRA Rule 152(5)(a) for presenting BINTANG TIMOR (V223) for slow work on grass track which was designated for fast work during trackwork on the above date.

RACE 10 (R1253) CLASS 5 A – 1200M (SC A4), SUNDAY, 19 NOVEMBER 2023, SELANGOR TURF CLUB NOVEMBER MEETING 2023

The Stewards, on Thursday, 4 January 2024 at SLTC, concluded an inquiry into the riding of CAORUNN and took evidence from App H Haikal, the rider of the CAORUNN, in the presence of his Employing Trainer, HY Cheng, and Trainer S Hamilton, the Trainer of the gelding.

The Stewards reviewed the films of the incident and considered the evidence tendered. App H Haikal (CAORUNN) pleaded guilty to a charge under MRA Rule 44(10) in that he failed to ride to the satisfaction of the Stewards. The particulars of the charge being that he failed to ride CAORUNN in a satisfactory vigour and determination, especially in the straight at the 400M despite the gelding running on, on two (2) occasions.

In assessing the penalty, the Stewards took into consideration App H Haikal’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of one (1) month with effect from 8 January 2024 and to expire on 7 February 2024, both dates inclusive. He was also fined RM10,000/- and was advised of his Right of Appeal (11:26am).

App R Nuqman (LANKARAN) who lodged an appeal against his suspension of three (3) Malaysian race days for careless riding under MRA Rule 44(9)(a)(ii), applied to withdraw his appeal on 2 January 2024. After consideration, his application was accepted, however, App R Nuqman’s deposit was forfeited. His suspension commenced on 6 January 2024 and to expire on 13 January 2024, both dates inclusive.

AMENDMENT

RACE 9 (R1307) CLASS 4 A – 1400M (LC A), SUNDAY, 3 DECEMBER 2023, SELANGOR TURF CLUB DECEMBER MEETING 2023

Jockey S Ruzaini (GOLDEN PEACH) who lodged an appeal against his suspension of two (2) Malaysian race days for careless riding under MRA Rule 44(9)(a)(ii), applied to withdraw his appeal on 2 January 2024, which application was granted. His deposit was forfeited.

Jockey S Ruzaini further applied for his suspension incurred on the above date to be converted to a fine. The Stewards, after considering the matter, accepted Jockey S Ruzaini’s application and converted his entire suspension to a RM3000/- fine. Jockey S Ruzaini is now free of embargo.

AMENDMENT

RACE 2 (R1289) CLASS 5 B – 1300M (LC A), SATURDAY, 2 DECEMBER 2023, SELANGOR TURF CLUB DECEMBER MEETING 2023

The Stewards have granted permission for a part of the suspension (1 Malaysian race day) of Jockey S Hafis (NORTHERN KNIGHT) under MRA Rule 44(6) incurred on the above date to be converted to a fine of RM1500/-. Jockey S Hafis’ embargo is now amended to a suspension which commenced on 11 December 2023 to expire on 6 January 2024, both dates inclusive.

At the conclusion of an inquiry, Jockey AM Aizat, the rider of SPEEDY DEMON, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding SPEEDY DEMON in this race in that he allowed his horse to shift in when insufficiently clear of GOOD WARRIOR and MY MONEY shortly after the start, subsequently allowed his horse to shift in, which resulted in THE STORM, QIJI LOVE and STEEL CUTTER being carried in and thereafter approaching the 1100M, again allowed his horse to shift in which resulted in THE STORM and QIJI LOVE being tightened which contributed to STEEL CUTTER clipping heels and its rider being dislodged.

In assessing the penalty, the Stewards took into consideration Jockey AM Aizat’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of four (4) Malaysian race days, to be deferred, with effect from 31 December 2023 and to expire on 14 January 2024, both dates inclusive. He was also fined RM1000/- and advised of his Right of Appeal.

At the conclusion of an inquiry, App M Lukman, the rider of CHINO DINERO, in the presence of his Employing Trainer, WC Lim, was found guilty of a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding CHINO DINERO in this race, he allowed his horse to shift in when insufficiently clear of QIJI LOVE approaching the 200M which resulted in QIJI LOVE clipping heels.

In assessing the penalty, the Stewards took into consideration App M Lukman’s mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 25 December 2023 and to expire on 6 January 2024, both dates inclusive. He was advised of his Right of Appeal.

At the conclusion of an inquiry, Jockey WW Cheah, the rider of NEW GARDEN, was found guilty of a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding NEW GARDEN in this race, at approximately the 1100M, he eased the pace to the extent that it contributed to QIJI LOVE becoming awkwardly placed on heels and having to ease and in turn, causing STEEL CUTTER positioned behind QIJI LOVE, to become awkwardly placed and clip heels, which resulted in App R Nuqman being dislodged.

In assessing the penalty, the Stewards took into consideration Jockey WW Cheah’s mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of five (5) Malaysian race days with effect from 14 January 2024 and to expire on 4 February 2024, both dates inclusive, to be served consecutively with any other penalty. He was advised of his Right of Appeal.

The Stewards, on Friday, 15 December 2023 at the Selangor Turf Club, concluded an inquiry into the riding of ORDOS LEGEND and took evidence from Jockey HS Gill, the rider of ORDOS LEGEND.

The Stewards reviewed the films of the incident and considered the evidence tendered. Jockey HS Gill (ORDOS LEGEND) pleaded guilty to a charge under MRA Rule 44(6) in that he failed to ride his horse out to the end of the race to the satisfaction of the Stewards. The particulars of the charge being that in Race 4 run on Sunday, 10 December 2023 at the Selangor Turf Club, he failed to ride ORDOS LEGEND out to the end of the race in the concluding stages to the satisfaction of the Stewards, thereby prejudicing his chances of obtaining third position.

In assessing the penalty, the Stewards took into consideration Jockey HS Gill’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of one (1) month with effect from 18 December 2023 and to expire on 17 January 2024, both dates inclusive. He was advised of his Right of Appeal.

The Stewards, on Friday, 15 December 2023 at the Selangor Turf Club, concluded an inquiry into the riding of AYAAN and took evidence from App A Nazir, the rider of AYAAN, in the presence of his Employing Trainer, F Maynard, and Trainer K Ananthen, the Trainer of AYAAN.

The Stewards reviewed the films of the incident and considered the evidence tendered. App A Nazir, the rider of AYAAN, in the presence of his Employing Trainer, F Maynard, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding AYAAN in this race, he failed to take reasonable steps to ensure that he did not cause interference to BOSSKU (HK Cheng), CAORUNN (SU Lim) and LET’S COME ON BABY (App AB Riduan) when shifting across runners at the 1100M mark.

In assessing the penalty, the Stewards took into consideration App A Nazir’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) Malaysian race days, to be deferred, with effect from 24 December 2023 and to expire on 6 January 2024, both dates inclusive. The Stewards, on Friday, 15 December 2023 at the Selangor Turf Club, concluded an inquiry into riding of D’GREAT RICH and took evidence from Jockey L De Souza, the rider of D’GREAT RICH.

The Stewards reviewed the films of the incident and considered the evidence tendered. Jockey L De Souza, the rider of D’GREAT RICH, was found guilty of a charge under MRA Rule 44(10) in that he failed to ride to the satisfaction of the Stewards. The particulars of the charge being that in Race 9 run on Sunday, 10 December 2023 at the Selangor Turf Club, he failed to ride D’GREAT RICH in satisfactory vigour and determination in the straight and in particular over the final 200M of the race despite his mount being in contention at the finish.

In assessing the penalty, the Stewards took into consideration Jockey L De Souza’s mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) months and fined RM30,000/-. He was advised of his Right of Appeal.

Jockey L De Souza subsequently exercised his Right of Appeal and applied for a Stay of Sentence. The Panel of Stewards considered the application for a stay which was granted. The appeal hearing against the penalty of the suspension of two (2) months and fine of RM30,000/- will be held at a date to be fixed.

The Stewards investigated further, into a report from Usains Biomics that OFFICIAL (unplaced) had “failed the pre-race testing criteria” in the above race.

It was established that there was no prohibited substance used on the horse. The Stewards took no further action in this matter.

At the conclusion of an inquiry, App R Nuqman, the rider of LANKARAN, in the presence of his Employing Trainer, BT Lim, was found guilty of a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding LANKARAN in this race, he failed to ensure that he did not cause interference to ELISE (App A Nazir) at the 1100M mark.

In assessing the penalty, the Stewards took into consideration App R Nuqman’s mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) Malaysian race days with effect from 11 December 2023 and to expire on 24 December 2023, both dates inclusive. He was advised of his Right of Appeal.

At the conclusion of on inquiry, App A Nazir, the rider of ELISE, in the presence of his Employing Trainer, F Maynard, pleaded guilty to a charge under MRA Rule 44(11) in that after the running of this race, he failed to report an incident that occurred at about the 1100M where he received pressure from LANKARAN which caused his mount to ease and lose ground to other runners.

In assessing the penalty, the Stewards took into consideration App A Nazir’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 11 December 2023 and to expire on 23 December 2023, both dates inclusive. He was advised of his Right of Appeal.

In the concluding stages, VILLAGE WARRIOR (KC Tham) shifted out away from the whip from the 300M, bumping GRAND CHOICE (S Ruzaini) which became severely unbalanced.

An objection was lodged by Jockey S Ruzaini, the rider of the second placed horse (GRAND CHOICE) against the winner, VILLAGE WARRIOR (KC Tham) on the grounds of interference in the straight.

After considering the evidence in this matter, the Board upheld the objection. In arriving at this decision, the Board considered that the distance between the horses at the finish, impact of the interference caused and that from the footage of the race, in particular the side-on angle, it was evident that as GRAND CHOICE was about to definitely take the lead, it was bumped by VILLAGE WARRIOR and had its momentum stopped.

Consequently, the Board was satisfied that for the above incident, GRAND CHOICE would have finished ahead of VILLAGE WARRIOR, therefore it upheld the objection and amended the Judge’s result to read:

Jockey S Ruzaini (GOLDEN PEACH) subsequently exercised his Right of Appeal and applied for a Stay of Sentence. The Panel of Stewards considered the application for a stay which was granted. The appeal hearing against the penalty of the suspension of two (2) Malaysian race days will be held at a date to be fixed.

The Stewards, on Friday, 8 December 2023 at the Selangor Turf Club, concluded an inquiry into the riding of NORTHERN KNIGHT and took evidence from Jockey S Hafis, the rider of the gelding.

The Stewards reviewed the films of the incident and considered the evidence tendered. Jockey S Hafis (NORTHERN KNIGHT) pleaded guilty to a charge under MRA Rule 44(6) in that he failed to ride his horse out to the end of the race to the satisfaction of the Stewards. The particulars of the charge being that in Race 2 run on Saturday, 2 December 2023 at the Selangor Turf Club, he failed to ride NORTHERN KNIGHT out to the end of the race in the concluding stages to the satisfaction of the Stewards, thereby prejudicing his chances of obtaining third position.

In assessing the penalty, the Stewards took into consideration Jockey S Hafis’ guilty plea, mitigating factors, previous riding record and his submissions on penalty. The Stewards reviewed the films of the incident and considered the evidence tendered. Jockey AM Aizat (JOKER NINE SIX) was found guilty of a charge under MRA Rule 44(10) in that he failed to ride to the satisfaction of the Stewards. The particulars of the charge being that in Race 10 on Sunday, 3 December 2023 at the Selangor Turf Club, … :

Between the 500M and the early part of entering the straight, he switched JOKER NINE SIX into a racing line directly behind another runner, INTENT (App H Haikal) despite a clear run presenting itself ahead of him prior to the switch and a clear run being available outside of INTENT;
Between approximately the 450M and leaving the 400M, after adopting a racing line behind INTENT, his riding is passive, lacking in vigour and unresponsive to INTENT gaining an advantage of JOKER NINE SIX; and
After switching out for clear running leaving the 400M, from this point to the 200M mark, despite having the opportunity to ride with the requisite vigour, his riding again lacked INTENT, was passive and non-vigourous.

In assessing the penalty, the Stewards took into consideration Jockey AM Aizat’s mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of six (6) months with effect from 11 December 2023 and to expire on 10 June 2024, both dates inclusive. He was also fined RM20,000/- and was advised of his Right of Appeal.

In assessing the penalty, the Stewards took into consideration App H Haikal’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days, with effect from 11 December 2023 and to expire on 23 December 2023, both dates inclusive, to be served consecutively with any other suspension. At the conclusion of an inquiry, App M Ekdihar, the rider of PACIFIC EMPIRE, in the presence of his Employing Trainer, SY Lim, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii). The particulars of the charge being that he failed to take all reasonable steps in order to prevent PACIFIC EMPIRE from shifting in at the 900M which shift resulted in MAGNITUDE (J Low) clipping its heels and Jockey J Low being dislodged.

In assessing the penalty, the Stewards took into consideration App M Ekdihar’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. App M Ekdihar explained to the Board that after XIONG FONG had shifted in away from the whip, he had anticipated that the run would close and he would not have clear running. He further explained that whilst his run had stayed open, at that juncture, he had already committed to an outward movement. The Board noted the explanation of App M Ekdihar.

At the conclusion of an inquiry, App H Haikal, the rider of STRETCHY FOUR, in the presence of his Employing Trainer, HY Cheng, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding STRETCHY FOUR in this race, he failed to ensure that he did not cause interference to STORM TO WIN (App A Nazir) and SHOQEET (E Ferreira) at approximately the 700M.

In assessing the penalty, the Stewards took into consideration App H Haikal’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 4 December 2023 and to expire on 10 December 2023, both dates inclusive. He was advised of his Right of Appeal.
