At the conclusion of an inquiry, Jockey AM Aizat, the rider of BLEU MARINE, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he failed to take reasonable steps and caused interference to NAJWAN (J De Souza) approximately at the 1300M.

In assessing the penalty, the Stewards took into consideration Jockey AM Aizat’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 13 November 2023 and to expire on 19 November 2023, both dates inclusive. He was advised of his Right of Appeal (2:45pm).

Jockey J Low (CAPONE) appeared before the Board and was questioned regarding his riding on CAPONE. In this regard, his attention was specifically drawn to the fact that after jumping well and obtaining the position behind the leader, he allowed his mount to drift back and WECANDO (SU Lim) to take his position in the running.

Jockey J Low explained to the Board that it was his instructions to ride this horse midfield therefore, he did not want to overly pressure this gelding to hold the position behind the leader as it would have been contrary to his instructions. Accordingly, he attempted to settle his mount, finding a position where it was comfortable and allowed it an opportunity to settle and run on in the straight. However, he further explained that despite travelling well in the running, this horse had nothing to come in the straight and faded tamely. The Board noted the explanation of Jockey J Low. Additionally, the Board interviewed Trainer HY Cheng who confirmed the statements of Jockey J Low in so far as they related to him.

Jockey S Ruzaini reviewed the footage of the race pertaining to the incidents involving CHEVAL BLANC and MALAYSIA CAPTAIN. This was followed by an objection being lodged by the Jockey S Ruzaini, the rider of the second placed horse (MALAYSIA CAPTAIN) against the winner, CHEVAL BLANC (KC Tham) on the grounds of interference and intimidation from the 450M. After considering the evidence in this matter, the Board overruled the objection. In arriving at this decision, the Board considered that, the distance between 2nd and 1st at the finish was 0.75L, notwithstanding the incident, MALAYSIA CAPTAIN appeared to have every opportunity to race past CHEVAL BLANC in the concluding stages and from the footage, and in particular the side-on angle, it appeared that CHEVAL BLANC always had the measure of MALAYSIA CAPTAIN. 

Consequently, the Board could not be satisfied that but for the above incident, MALAYSIA CAPTAIN would have finished ahead of CHEVAL BLANC, therefore it overruled the objection and allowed the Judge’s result to stand.

In assessing the penalty, the Stewards took into consideration Jockey J Daniel’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 13 November 2023 and to expire on 19 November 2023, both dates inclusive. He was advised of his Right of Appeal (6pm).

Prior to the running of this race, the Stipendiary Stewards observed that the ear-muffs impeded the gelding’s vision. Accordingly, Trainer EP Tan was advised of this occurrence and it was ordered by the Stewards that this equipment be removed. Trainer EP Tan was also issued with a reprimand. Had no pace despite being urged.

Was ridden aggressively from the jump in order to obtain a forward position. Thereafter at the 900M, the gelding obtained the lead, however, was unable to cross to the rail and raced in a one-off position until entering the straight.

Approaching the 1000M, ducked in sharply which resulted in Jockey S Saddam being dislodged. Jockey S was examined by the Club Doctor who stood him down from his riding engagements for the remainder of the races today, and was subsequently taken to the hospital for further observation.

Was bumped in severely approaching the 1000M. In the straight, was hanging in, proving difficult to assist. This resulted in the Apprentice being unable to fully assist this gelding in the straight. *(See Report)

App AB Riduan appeared before the Stewards, was shown the patrol film of the race, and advised that when his mounts were demonstrating such behavioural traits, and was advised that when he is unable to use his whip in the correct hand, he should ride his mounts under strong hands and heels ride until the end of the race rather than risking them shifting away from the whip.

App AB Riduan and his Employing Trainer, HY Cheng appeared before the Stewards and was questioned regarding App AB Riduan’s riding of HANDSOME BOY in the straight. In this regard, the Stewards specifically drew App AB Riduan’s attention to his looking back whilst using his whip, HANDSOME BOY shifting in behind runners at the 300M and the non-vigourous nature of his riding between the 200M and the 100M.

App AB Riduan explained that it was his riding style to move his head back between the 200M to the 100M whilst using his whip and that after he struck HANDSOME BOY with the whip, this gelding shifted in which resulted in it becoming awkwardly placed on heels. Therefore, he allowed this gelding to shift further in order to obtain clear running. The Stewards noted and accepted the explanation provided.

In respect of his non-vigourous riding, neither App AB Riduan nor Trainer HY Cheng were able to provide the Stewards with an acceptable explanation. However, in determining what sanction to take in this matter, the Stewards were of the view that prejudice from the Apprentice’s riding between the 200M to the 100M could not be definitely established after considering the finishing position of HANDSOME BOY and the distance between the first and second placings. Accordingly, App AB Riduan was issued with a severe reprimand.

At the conclusion of an inquiry, Jockey A Suriya, the rider of MAINSTREAM, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he shifted in at about the 1000M when insufficiently clear of KALA GHODA causing him to check and lost some ground.

In assessing the penalty, the Stewards took into consideration Jockey A Suriya’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 6 November 2023 and to expire on 19 November 2023, both dates inclusive. He was advised of his Right of Appeal (5:45pm).

GENERAL REPORT(S) – SLTC

RACE 6 (R491) Class 4b – 1200M (A4 sc), SATURDAY, 6 MAY 2023, SELANGOR TURF CLUB MAY MEETING 2023

The Stewards, on 23 October 2023 at the Selangor Turf Club, concluded their investigation into the reason for BLOOD ROYAL (App KH Chong) falling.

Jockey CK Khaw (GUILTY PLEASURES) and App KH Chong (who has been unavailable due to injury), along with Trainer R Lines, the Employing Trainer of App KH Chong and Trainer of BLOOD ROYAL, gave evidence.

It was concluded that BLOOD ROYAL had clipped the heels of HAPPY THIRTYNINE (L De Souza) at about the 400M and fell. GUILTY PLEASURES was unable to avoid the fallen horse and it too, fell near the 400M.

The site of the fall was examined immediately after the incident and was observed to be unremarkable. Further, neither BLOOD ROYAL or GUILTY PLEASURES suffered any injuries other than minor abrasion and post incident swellings.

The Stewards concluded that the incident, though having serious consequences cases, was a race incident and no rider was considered to be at fault.

It was ascertained that WHIZ FIZZ (App T Ammar) had laid in early in the race and was unable to relieve the pressure when QIJI DIAMOND (App M Ekdihar) improved on its outside. The Stewards warned App M Ekdihar that he ought to afford runners on his inside sufficient room.

Jockey AM Aizat advised that BLEU MARINE had laid inwards considerably from the 300M. Although using his whip in his left hand to keep the gelding out, he had been obliged to straighten it with his right hand on several occasions. Rider advised he should ride all his mounts so as to present no question to his true purpose.  

RACE 5 (R1138)       OPEN MAIDEN – 1400M (LC A)

When the start was effected, the Starter was of the opinion that DRAGON SANDS (App R Nuqman) had breached its gate and as such the Starter effected the false start mechanism, all riders subsequently restrained their mounts.

The Panel of Stewards ascertained that DRAGON SANDS had reared and struck the gate, giving the impression it had prematurely opened. After veterinary examination of all horses, the Panel of Stewards was of the opinion that it was inappropriate to run the race and as such under the provisions of MRA Rule 114(1), the race was void.

Given the history of DRAGON SANDS in relation to its barrier manners, the gelding will be required to pass 2 Starting Stall tests before being declared to race again.

Shortly after the start, REBORN GENERAL (J Low) and JOCKEY KING (App AB Riduan) had to check with JOCKEY KING striking the heels of MY GOODNESS (Pre. App. S Bahauddin).

It was ascertained that Jockey WW Cheah (LISBOA STAR) had shifted in shortly after the start, thereby causing the crowding. The Stewards advised Jockey WW Cheah to keep riding within the Rules and severely reprimanded him. He was also advised that a repetition could lead to a suspension of his license to ride in races.

At the conclusion of an inquiry, Jockey KP Lim, the rider of MYSTERIOUS CAPTAIN, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he shifted in approaching the 1050M and tightened several runners.

In assessing the penalty, the Stewards took into consideration Jockey KP Lim’s guilty plea, mitigating factors, good recent riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 2 October 2023 and to expire on 14 October 2023, both dates inclusive. GENERAL REPORT(S) – SLTC

RACE 4 (R1040) CLASS 5 A – 1175M (Track II), SUNDAY, 24 SEPTEMBER 2023, SELANGOR TURF CLUB SEPTEMBER MEETING 2023 

The Stewards, on Friday, 29 September 2023 at the Selangor Turf Club, concluded an inquiry into Jockey M Ewe’s riding of ROYAL FLUSH in the above race. Further evidence was taken from Jockey M Ewe, who did not present any further witnesses.

After considering the evidence and also reviewing the performance of ROYAL FLUSH, the Stewards found Jockey M Ewe guilty under MRA Rule 44(8) for failing to take all reasonable and permissible measures throughout the race to ensure that ROYAL FLUSH was given full opportunity of winning or of obtaining the best possible placing in that he had failed to ride the mare out in the straight from the 200M mark.

The Stewards took into consideration Jockey M Ewe’s riding record, mitigating factors and his submissions on penalty. He was disqualified for a period of one (1) year with immediate effect from 29 September 2023 and to expire on 28 September 2024, both dates inclusive. He was also fined RM50,000/- and advised of his Right of Appeal (3:35pm).

Jockey M Ewe subsequently exercised his Right of Appeal and applied for a Stay of Sentence. The Panel of Stewards considered the application for a stay which was not granted. The appeal hearing will be held at a date to be fixed.

Further, as Trainer HY Cheng was unable to attend the inquiry, he will be called at date to be advised for the continuation of the inquiry related to his evidence as the Trainer of ROYAL FLUSH.

RACE 3 (R0994) CLASS 5A – 1250M (LC A), SATURDAY, 16 SEPTEMBER 2023, SELANGOR TURF CLUB SEPTEMBER MEETING 2023 

Jockey Z Khairil (BAGHDAD) who lodged an appeal against his suspension of three (3) months under MRA Rule 44(10), applied to withdraw his appeal on 26 September 2023. After consideration by the Appeal Panel, his application was acceded to, with RM2000/- of his deposit being forfeited. His suspension commenced on 27 September 2023 and to expire on 26 December 2023, both dates inclusive.

In assessing the penalty, the Stewards took into consideration App A Najib’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 30 September 2023 and to expire on 8 October 2023, both dates inclusive. He was advised of his Right of Appeal.

After considering the evidence and also reviewing the performance of ROYAL FLUSH, the Stewards charged Jockey M Ewe under MRA Rule 44(8) for failing to take all reasonable and permissible measures throughout the race to ensure that ROYAL FLUSH was given full opportunity of winning or of obtaining the best possible placing in that he had failed to ride the mare out in the straight from the 200M mark. 

The inquiry was adjourned to a date to be fixed in order to allow Jockey M Ewe to provide further evidence and witnesses.

In assessing the penalty, the Stewards took into consideration App SN Shiva’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days, to be deferred, with effect from 24 September 2023 and to expire on 30 September 2023, both dates inclusive. He was advised of his Right of Appeal. Further, Jockey WW Cheah (BINTANG TIMOR) was reprimanded for failing to straighten more readily thus exasperating the incident.

The Stewards advised rider to exercise caution when steadying his mount in future. Vet inspection: Sustained multiple cuts on the medial aspect of the near hind cannon – Vet exam.

The Stewards inquired into Jockey Z Khairil’s riding of BAGHDAD in this race. Evidence was taken from Jockey Z Khairil and Trainer NM Selvan, the rider and trainer of BAGHDAD respectively. 

After considering the evidence and also reviewing the performance of BAGHDAD, Jockey Z Khairil pleaded guilty to a charge under MRA Rule 44(10) for failing to ride to the satisfaction of the Stewards. The particulars of the charge being that although instructed that BAGHDAD be ridden in its customary “on pace” position that he had restrained the gelding shortly after the start and he had failed to keep up with the pace whereby BAGHDAD was in a mid-to-rearward position until straightening, thereby diminishing its chances. 

The Stewards took into consideration Jockey MM Z Khairil’s guilty plea, riding record, mitigating factors and his submissions on penalty. He was suspended from riding in races for a period of three (3) months with effect from 18 September 2023 and to expire on 17 December 2023, both dates inclusive. He was advised of his Right of Appeal. 

Trainer NM Selvan, the Trainer of BAGHDAD, was advised by the Stewards that they had serious concerns related to the fact the on four (4) occasions, they had questioned the running and handling of his horses with two (2) of those occasions resulting in the suspension of riders under serious charges. He was advised that it was expected that all his runners must be ridden so as to be fully tested and should there be further occurrences of issues of question, that a report would be made to the Committee of the SLTC related to the matter. 

On inquiry, Jockey WW Cheah, the rider of I’M SMART GREY, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he had shifted in, crowding RAHOTU which had to be restrained near the 950M.

In assessing the penalty, the Stewards took into consideration Jockey WW Cheah’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) Malaysian race days, to be deferred, with effect from 24 September 2023 and to expire on 1 October 2023, both dates inclusive. He was advised of his Right of Appeal.

GENERAL REPORT(S) – SLTC

THURSDAY, 14 SEPTEMBER 2023, SLTC

The Stewards concluded an inquiry into the presence of STR H Bukhari being attendant at the stables on the morning of 27 August 2023.

After taking initial evidence from two (2) Trainers, the inquiry was adjourned to allow for the results of samples taken for a runner, from that stable to be advised.

Whilst Stewards considered no nefarious act had been perpetrated, STR H Bukhari was reprimanded for being in the stables during the period of SLTC imposed pre-race curfew and advised that should he offend again that he risks his license being suspended.

AMENDMENT

RACE 3 (R0946) CLASS 5A – 1200M (LC A4), SUNDAY, 3 SEPTEMBER 2023, SELANGOR TURF CLUB SEPTEMBER MEETING 2023 

On inquiry, App I Fikri, the rider of STARDICE, in the presence of his Employing Trainer, L Moy, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he allowed his mount to shift in causing STAY THE COURSE to check.

In assessing the penalty, the Stewards took into consideration App I Fikri’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of three (3) SLTC race days with effect from 4 September 2023 and to expire on 17 September 2023, both dates inclusive. He was advised of his Right of Appeal.
