The Stewards inquired into Jockey KC Tham’s riding of BEIJING STAR. Evidence was taken from the rider and Trainer HY Cheng’s Assistant Trainer. Jockey KC Tham stated that the gelding had dwelt when the start was effected and he had lost considerable ground and had steadiedly made up ground to follow the field by the 750M. On straightening, he had allowed BEIJING STAR to become balanced before riding vigourously from near the 375M. A subsequent veterinary examination revealed that it was lame off fore.

After taking into consideration BEIJING STAR’s poor trial history whereby it had been referred for trials and failed on several occasions and the post-race veterinary reports, the Stewards considered they could not substantiate a charge against Jockey KC Tham under the Rules however, he was severely reprimanded for what they consider was a lack of vigour.

Trainer HY Cheng’s Assistant Trainer was advised that given BEIJING STAR’s history, it will be required to pass 2 (1000M/vet) tests before being declared to race again.

The Stewards questioned App S Uzair (FLYING BABY) and Trainer CC Ooi related to the riding of the gelding. It was established that FLYING BABY was ridden in a rearward position after being tightened by LEOPARD ECLIPSE shortly after the start and that the gelding had tended to lay outwards from the 800M. App S Uzair stated that he had purposely ridden with the whip in his non-preferred right hand as the gelding had hung out at its previous start. Further, FLYING BABY had again laid outwards in the straight and that he had attempted to straighten whilst riding with the whip in the right hand.

Whilst accepting this in part, the Stewards severely reprimanded App S Uzair for what they considered was a lack of vigour in trying to ride his horse out albeit when laying outwards.

RACE 2 (R1205) CLASS 5 (A) – 1300M (A LONG COURSE),             SATURDAY, 15 OCTOBER 2022, SELANGOR TURF CLUB OCTOBER MEETING 2022

The Stewards concluded an inquiry into App S Shazmin’s riding of D’GREAT DUCHESS in the above race.

After taking initial evidence from App S Shazmin, the rider of D’GREAT DUCHESS, in the presence of his Employing Trainer’s representative, and also Trainer S Siva, the Trainer of D’GREAT DUCHESS, the Stewards considered they could not substantiate a charge in terms of the Rule. However, App S Shazmin was severely reprimanded for not having positioned D’GREAT DUCHESS in a midfield position in the early stages of the race.

Trainer S Siva was advised that his riding instructions must be consistent with prior racing styles unless specifically advised to the Stewards.

GENERAL REPORT(S) – SLTC

SUNDAY, 25 SEPTEMBER 2022, SLTC SEPTEMBER MEETING 2022

The Stewards addressed the issue of App S Shazmin’s proclivity to look around when winning in:

  1. Race 1 – D’GREAT DUCHESS

  2. Race 4 – LEO

  3. Race 7 – DIAMONDS

Whilst App S Shazmin had looked around to varying degrees in those races, the Stewards advised App S Shazmin that he must focus on the ride to the finish and resist the temptation to look around.

RACE 7 (R1139) CLASS 4 (A) – 1175M (II), SUNDAY, 25 SEPTEMBER 2022, SELANGOR TURF CLUB SEPTEMBER MEETING 2022

A subsequent veterinary examination of SORBETA (WK Lee) which finished distance, revealed no obvious abnormalities. He also stated that it was his intention to effect a gear change and undertook to trial SORBETA before racing again.

10 & 11 SEPTEMBER 2022

SELANGOR TURF CLUB SEPTEMBER MEETING 2022

The report dated 23 September 2022 (V22/142) from the Chief Analyst of Veterinary Forensic Laboratory stated that 4 coded urine samples from the above mentioned race meeting were received on 11 September 2022, for analysis under the MRA Rules and Regulations. No prohibited substances were detected except for sample coded “J-4309” which revealed the presence of “pseudoephedrine”. *(See subsequent Report below)

INQUIRY INTO A REPORT CONCERNING URINE SAMPLE CODED “J-4309” WHICH WAS TAKEN ON 10 SEPTEMBER 2022 AT THE SELANGOR TURF CLUB, WAS FOUND TO CONTAIN “PSEUDOEPHEDRINE”

A report of Sample No. J-4309 confirmed the presence of pseudoephedrine. Upon decoding, it was ascertained that the sample had been taken from Jockey SU Lim.

An inquiry into the finding was conducted on Sunday, 25 September 2022. Specific evidence was tendered by Jockey SU Lim that he had declared the use of a nasal decongestant prescribed by EE Clinic, on the Sample Card Declaration Form, for the sample taken on 10 September 2022 on which day he rode.

The Chief Analyst of Usains Biomics Laboratory Testing Services Sdn. Bhd., Dr Chan Sue Hay confirmed that the prescribed medication declared contained the substance (pseudoephedrine) and the declared dose timing was consistent with the findings of the declared medication.

The Stewards were satisfied that the presence of pseudoephedrine was as a result of this prescribed medication and took no direct action related to the reported sample.

As such, Jockey SU Lim was permitted to ride on 25 September 2022 and submitted a sample.

GENERAL REPORT(S) – SLTC

TUESDAY, 20 SEPTEMBER 2022, SLTC OFFICIAL BARRIER TRIAL 5

Jockey WK Lee (ROBBEN) was reprimanded under the provisions of MRA Rule 44(9)(a)(ii) for failing to straighten his mount, thereby crowding runners shortly after the start.

 WEDNESDAY, 21 SEPTEMBER 2022

The Stewards, on 21 September 2022 at the Selangor Turf Club, inquired into the reason THUNDERGOD was entered to race on 28 August 2022 when no “Clearing Sample” had been received, analysed and cleared following an inquiry into the presence of flunixin in its urine sample after racing on 24 July 2022.

Trainer HY Cheng was subsequently fined RM1000/- for negligence in breaching MRA Rule 134(12) by entering THUNDERGOD to race on the 28th of August 2022, contrary to the provisions of that Rule.

Further, a veterinary examination of THUNDERGOD ascertained that the vision of the gelding was not impaired in any way and it was subsequently cleared to race.

 RACE 4 (R1108) CLASS 5 (A) – 1500M (C4 SHORT COURSE), SUNDAY, 18 SEPTEMBER 2022, SELANGOR TURF CLUB SEPTEMBER MEETING 2022

The Stewards, on 21 September 2022 at the Selangor Turf Club, inquired into App I Fikri’s riding of BEAUTIFUL ONE over the concluding stages in the above race. Evidence was taken from App I Fikri, in the presence of his Employing Trainer, L Moy who is also the Trainer of BEAUTIFUL ONE.

Trainer L Moy stated that it was intended that BEAUTIFUL ONE be ridden midfield but due to the slow early pace, was positioned just behind the leader. He was pleased that the gelding had performed well to finish third.

App I Fikri advised that he had attempted to ride BEAUTIFUL ONE in a similar fashion to previous but advised that he had changed his whip style, which he considered was more effective.

In accepting this evidence, the Stewards were satisfied that App I Fikri had ridden BEAUTIFUL ONE in a manner so as to be fully tested when finishing third, five (5) lengths ahead of the fourth place horse.

Given that numerous horses completed the course, after all runners were examined by the veterinary surgeon, it was deemed inappropriate to consider the re-running of the race

Under the provisions of MRA Rule 114(1), the Stewards deemed it was declared a “False Start” and the race was subsequently voided.

Evidence was taken from Trainer SY Lim, the Trainer of NICATOR, Mr Mohamd Saidi Bin Saini, his Stable Supervisor, a Stable Syce, Dr Shri Kanth (Chief Veterinary Surgeon), two (2) Veterinary Surgeons and one (1) Vet’s Assistant from the SLTC Veterinary Department.

It was established that NICATOR had been administered certain medication prior to this time which the Veterinary Department had no record and had not administered any furosemide to NICATOR, otherwise it would have been precluded from being presented for a trial testing.

Subsequently, Trainer SY Lim pleaded guilty to charge under MRA Rule 135(7) in that he, as the trainer and person responsible for presenting NICATOR, to trial for 1000M/vet Test for Respiratory Distress on Tuesday, 23 August 2022, the subsequent Post-Trial/Test sample having detected in it furosemide, a prohibited substance. Trainer SY Lim was fined RM2000/- and advised of his Right of Appeal.

Further, Stable Supervisor Mohamd Saidi Bin Saini pleaded guilty to charge under MRA Rule 135(9) in that he was a party to NICATOR being presented for a Trial Testing with a prohibited substance, furosemide in its system.

After considering the gravity of the offence and the impact on the integrity of Racing whereby a horse was presented to pass a test with a substance which could affect such test have been administered and detected, Stable Supervisor Mohamd Saidi was disqualified for a period of three (3) months with immediate effect.

Further, given that NICATOR had subsequently failed its test on that day, despite being presented with furosemide, the Stewards banned NICATOR from racing for a period of three (3) months .

Under the provisions of MRA Rule 135(5A), Trainery SY Lim was advised that a “Clearing Sample” of NICATOR should be officially provided, analyzed and found to be free of any Prohibited Substance before being declared to race again.

 RACE 11 (R1073) CLASS 5 (A) – 1200M (A SHORT COURSE), SATURDAY, 10 SEPTEMBER 2022, SELANGOR TURF CLUB SEPTEMBER MEETING 2022

The Stewards, on 14 September 2022 at the Selangor Turf Club, concluded an inquiry into the riding of BOOM ALMIGHTY in the concluding stages. After taking evidence from Jockey L De Souza and Trainer R Lines, the rider and trainer of BOOM ALMIGHTY respectively, the Stewards found Jockey L De Souza guilty of a charge under MRA Rule 44(10) for failing to ride to the satisfaction of the Stewards. The particulars of the charge being that his riding in the straight on BOOM ALMIGHTY lacked vigour and purpose, and in the opinion of the Stewards, was inconsistent with the riding style he demonstrated in the majority of occasions.

In assessing the penalty, the Stewards took into consideration Jockey L De Souza’s mitigating factors, previous riding record and his submissions on penalty. Further, in considering a condign penalty, the Stewards were conscious of the provisions of MRA Rule 48(4)&(8) related to Jockey L De Souza as the holder of a Visiting Jockey Licence.

He was suspended from riding in races, to be deferred, with effect from 19 September 2022 and to expire on 12 December 2022, both dates inclusive. In addition, he was fined the sum of RM25,000/- and advised of his Right of Appeal (3:15pm).

 RACE 12 (R1074) CLASS 5 (B) – 1200M (A SHORT COURSE), SATURDAY, 10 SEPTEMBER 2022, SELANGOR TURF CLUB SEPTEMBER MEETING 2022

The Stewards, on 14 September 2022 at the Selangor Turf Club, concluded an inquiry into the riding of GORDON G in the straight. After taking evidence from Jockey L De Souza and Trainer R Lines, the rider and trainer of GORDON G respectively, the Stewards warned Jockey L De Souza that he is expected to ride all horses so as to leave no doubt or query.

 RACE 5 (R1067) CLASS 4 (A) – 1250M (A LONG COURSE), SATURDAY, 10 SEPTEMBER 2022, SELANGOR TURF CLUB SEPTEMBER MEETING 2022

App WW Cheah (DRONE) subsequently exercised his Right of Appeal and applied for a Stay of Sentence. The Panel of Stewards considered the application for a stay which was granted.  The appeal hearing against the penalty of the suspension of one (1) month will be held at a date to be fixed.

REPORT OF ANALYSIS ON NON RACE-DAY SAMPLE:

TUESDAY, 23 AUGUST 2022

SLTC OFFICIAL BARRIER TRIAL

A report dated 1 September 2022 (NRD/V22/005) from the Chief Analyst of Veterinary Forensic Laboratory stated that 2 bottles of coded urine sample and 2 sets of coded blood samples from the above mentioned SLTC Official Barrier Trial were received on 28 August 2022, for analysis under the MRA Rules and Regulations. No prohibited substances were detected except for sample coded “17044” which revealed the presence of furosemide. After decoding the sample number, it was established that this sample was reported to have been taken from the horse NICATOR, which was taken on Tuesday, 23 August 2022 at an SLTC Official Barrier Trial.

On 6 September 2022, Trainer SY Lim was advised of the contents of this report and his attention drawn to MRA Rule 134(12) which prohibits this horse from racing until it is cleared by the Stewards, and MRA Rule 137(1)/MRA Regulation 46.1 & 46.2 relating to the referee sample. An inquiry will be held at a date to be fixed.

At the conclusion of an inquiry, App WW Cheah, the rider of DRONE, in the presence of his Employing Trainer, R Lines, was found guilty of a charge of incompetent riding under MRA Rule 44(9)(b)(iii) in that:

  1. He rode DRONE to lead by an inordinate margin mid-race; and

In assessing the penalty, the Stewards took into consideration App WW Cheah’s mitigating factors, previous riding record and his submissions on penalty. 11 JUST DUIT(App A Suriya) Returned cast near fore plate.
12 MISE EN GARDE(WK Lee) Rider fined RM250/- for using his whip excessively and advised that a repetition would lead to a suspension.

The Stewards questioned Jockeys HS Gill (MONDAY) and KP Lim (BIG G) relating to contact made over the final 200M. Jockey HS Gill stated that he had been crowded from his outside after having made initial contact with BIG G and when cramped for room when using his whip, he believed that BIG G was attempting to savage his horse. As such, he had extended his right arm and fended the gelding off. Although accepting this explanation, the Stewards reminded Jockey HS Gill of his obligation and entitlement related to not interfering with any other runner.

The Stewards inquired into Jockey KP Lim’s riding of BIG G in this race. Evidence was taken from Jockey KP Lim and Trainer SY Lim, the rider and trainer of BIG G respectively.

The Stewards considered the evidence tendered and also reviewed the films of BIG G. Jockey KP Lim pleaded guilty to a charge under MRA Rule 44(10) for failing to ride to the satisfaction of the Stewards. The particulars of the charge being that the manner in which he failed to exercise any vigour and failed to pull his horse out when in contact with MONDAY (HS Gill) over the final 150M.

The Stewards took into consideration Jockey KP Lim’s guilty plea, riding record, mitigating factors and his submissions on penalty. Further, the Stewards considered that the contact made and maintained by MONDAY having shifted out, was a mitigating circumstance. Subsequently, he was suspended from riding in races for a period of three (3) months with effect from 29 August 2022 and to expire on 28 November 2022, both dates inclusive. He was advised of his Right of Appeal (7:02pm).

6 GOLDEN SPRINT(App WW Cheah) Ridden wide throughout from its outside draw. Returned cast off fore plate.
8 RUNNING SPIRIT(KP Lim) Crowded shortly after the start, losing considerable ground.

Jockey S Ruzaini (GOLDEN KING) explained that although instructed to ride in a handy position, he had been severely crowded at the start and had thus been worse than midfield. On straightening, the gelding had kept the bit on one side and had shifted out. Given that it was his first ride on the gelding, it had taken him by surprise and though attempting to straighten, he had been unsuccessful.

Trainer HY Cheng stated that GOLDEN KING was having its initial start in Malaysia and suggested that it was best suited by staying type races. He also stated that he put Blinkers/Pacifiers as the gelding trialed somewhat greenly. In light of this, Trainer HY Cheng was advised that GOLDEN KING will be required to pass a 1000M/vet test (3 weeks embargo) before being declared to race again.
