HEARING OF THE APPEAL OF JOCKEY M.GANEESH AGAINST THE SIX (6) MONTHS’ SUSPENSION AND RM40,000/- FINE IMPOSED BY THE PANEL OF STEWARDS UNDER MRA RULE 44(10) IN CONNECTION WITH HIS RIDING AND HANDLING OF “BABY POLO” IN RACE 7 (R056) CLASS 4 – 1200M(sc) – PRINCE OF LALITA-1959 HANDICAP – PERAK TURF CLUB JANUARY DERBY MEETING 2018

The Appeal Panel heard the above appeal on Thursday, 16th August 2018 in the Perak Turf Club.

After hearing all submissions from Jockey M. Ganeesh, his counsel, his witnesses, the Panel of Stewards and after reviewing various angles of the films of the race and deliberating on the evidence tendered, the Appeal Panel dismissed the appeal and forfeited the deposit.  However, the penalty of six months suspension was reduced to three (3) months suspension and the fine of RM40,000/- remained.  Jockey M Ganeesh’s three months’ suspension will commenced on Thursday, 16th August 2018 and to expire on Saturday, 15th November 2018, both dates inclusive.

Under the provision of MRA Rule 169, there is no further right of appeal against the decision of the Appeal Panel.

GENERAL REPORT – SLTC

RACE 1 (R1002) CLASS 5-B – 1400M (LONG COURSE A), SUNDAY, 12 AUGUST 2018, SELANGOR TURF CLUB AUGUST MEETING 2018

The Stewards, on 14 August 2018 at the Selangor Turf Club, concluded an inquiry into the running and handling of UNION JAC. Evidence was taken from App A Zaimuddin, the rider of UNION JAC, in the presence of his Acting Master, B Trainer Veloo a/l Kanniah (BT. 9), the representative of Trainer BT Lim who is the Trainer of UNION JAC and Master for App A Zaimuddin.

App A Zaimuddin stated that UNION JAC has a tendency to wander off a straight line in the closing stages of his races, and it is not always possible to predict whether the gelding will shift inwards or outwards. The Stewards noted his evidence, but warned App A Zaimuddin that he should always ride in such a manner as to leave no room for query.

RACE 2 (R1003) CLASS 5-A – 1400M (LONG COURSE A), SUNDAY, 12 AUGUST 2018, SELANGOR TURF CLUB AUGUST MEETING 2018

The Stewards, on 14 August 2018 at the Selangor Turf Club, concluded an inquiry into the an incident at about the 100M in the above race. Evidence was taken from App A Zaimuddin, the rider of LIM’S SIGNATURE, in the presence of his Acting Master, B Trainer Veloo a/l Kanniah (BT. 9), the representative of Trainer BT Lim who is the Trainer of LIM’S SIGNATURE and Master for App A Zaimuddin. The Stewards also took evidence from Jockey M Ganeesh, the rider of DAWN OF THE WORLD, on 12 August 2018 (Saturday).

The Stewards found that interference had taken place at two (2) specific points. Firstly, at about the 100M, LIM’S SIGNATURE had shifted inwards under a right-handed drive, briefly bumping DAWN OF THE WORLD (M Ganeesh). App A Zaimuddin was warned that he would be expected to take all reasonable measures to keep his mounts straight under similar circumstances in future, including switching his whip hand when necessary.

Secondly, at about the 50M the Stewards observed that LIM’S SIGNATURE had shifted very slightly inwards at the same time as DAWN OF THE WORLD shifted outwards, causing Jockey M Ganeesh to check to avoid running on to the heels of LIM’S SIGNATURE. After reviewing the vision of this incident, it was established that no particular rider was to be blamed for this incident and as such the Stewards deemed it as a racing incident.

RACE 7 (R1008) OPEN NOVICE – 1400M (SHORT COURSE A), SUNDAY, 12 AUGUST 2018, SELANGOR TURF CLUB AUGUST MEETING 2018

The Stewards, on 14 August 2018 at the Selangor Turf Club, concluded an inquiry into an incident at about the 400M in the above race. Evidence was taken from Jockey Y Aify, the rider of MR WASHINGTON, and Jockey S Ruzaini, the rider DAHEES.

The Stewards concluded that at about the 400M, MR WASHINGTON had shied inwards away from ONFLEEK (J Low) when the rider of that horse drew his whip in the left hand and had thus caused interference to DAHEES. They warned Y Aify that although the initial contact was not caused by any error on his part, he should have subsequently taken steps to straighten his mount and that he would be expected to take immediate corrective measures in similar circumstances in future.

………………………..

RACE 6 (R960) CLASS 4 – 1200M (SHORT COURSE A), SATURDAY, 4 AUGUST 2018, SELANGOR TURF CLUB AUGUST MEETING 2018

In assessing the penalty, the Stewards took into consideration Jockey Y Aify’s guilty plea, mitigating factors, previous record and his submissions on penalty. He was fined RM500/- and advised of his Right of Appeal (3pm).

RACE 8 (R1009) METRO A (SW) – 1600M (SHORT COURSE A), SUNDAY, 12 AUGUST 2018, SELANGOR TURF CLUB AUGUST MEETING 2018

Evidence was taken from App W Faizal, the rider of BRILLIANT DEAL, in the presence of his Master, Trainer L Moy who is also the Trainer of BRILLIANT DEAL, Jockey S Ruzaini, the rider of LA FAMILIA, and App L De Souza, the rider of SEA WORLD.

In assessing the penalty, the Stewards took into consideration App W Faizal’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days with effect from 18 August 2018 and to expire on 19 August 2018, both dates inclusive. He was advised of his Right of Appeal (3:15pm).

RACE 1 (R790)  CLASS 4 – 1400m(lc)

NOTHING TO LOSE and JOYFUL, both course scratching as they were both sustained bruised off fore fetlock,  will each be required to pass a veterinary examination before being declared to race again.

BATTLE HORSE (Z Khairil) was slow into stride.

LISBOA STAR (App CK Khaw) raced wide from the 800M until entering the straight.

Racing to the 300M, STREET OF LONDON (A Aucharuz) had to be steadied to avoid the heels of WINNING TANGO (M Zairi) and shifted out to obtain clear running.

Post-race veterinary examinations of LISBOA STAR and STREET OF LONDON revealed no obvious abnormality.

The Club Veterinary Surgeon reported that STREET OF LONDON returned having cast its near fore plate and US DOLLAR  (M Ganeesh) returned having cast its off fore plate.

Prior to the “All Clear” being given, an objection was lodged by App KC Wong, the rider of COMMON SENSE placed 4th against US DOLLAR, the 3rd place-getter on grounds of alleged interference at the 200M.   After considering all the evidence, the Panel of Stewards were of the opinion that the alleged interference had not affected the result of the race.  The objection was overruled and the Judges’ results stood.

At the conclusion of an inquiry, Jockey M Ganeesh, the rider of US DOLLAR was found guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding US DOLLAR from the 100M, he permitted his mount to shift outwards when insufficiently clear of COMMON SENSE (App KC Wong), resulting in COMMON SENSE having to check and lose ground.

In assessing the penalty, the Panel of Stewards took into consideration Jockey M Ganeesh’s disciplinary record and mitigating factors.  Jockey M Ganeesh was suspended from riding in races for a period of 2 Malaysian race days, effective from Monday, 25th June 2018 and to expire on Sunday, 8th July 2018, both dates inclusive.  He was advised of his right of appeal (2.45pm).

Over the final 250M, GOOD PEOPLE shifted in away from the whip and at the same time, FOR FUN ONLY (App J Daniel) also shifted in.  Both these horses continued to shift ground until about the 100M when they brushed. Prior to the “All Clear” being given, an objection was lodged by jockey SU Lim, the rider of GOOD PEOPLE placed 2nd against FOR FUN ONLY (App J Daniel) being declared the winner on grounds of alleged interference at the 200M.   After considering all the evidence, the Panel of Stewards were of the opinion that the alleged interference had not affected the result of the race.  The objection was dismissed and the Judges’ results stood.

Post-race veterinary examinations of TILSWORTH JOSHI and PURPLE RAIN revealed no obvious abnormality.

The Panel of Stewards questioned Jockey S Sandana and Trainer K Coetzee, the rider and the trainer of CLASSIC KING respectively.  Jockey S Sandana stated that the gelding jumped away awkwardly, got its head up, shifted out and bumped JANGO (S Anandan) which laid in.  He further stated that as a result of this incident, he was unable to carry out the instructions, which is to be forward.   Then racing to the 1000M, TAKE A BOW (App W Faizal) laid out and raced ungenerously, losing ground, resulting in CLASSIC KING again having to be steadied.  Jockey S Sandana further stated CLASSIC KING responded fairly to his riding under the whip in the straight.   Trainer K Coetzee confirmed the instructions and agreed that if the gelding did not get a good jump, he would been placed further back than anticipated.  Their explanations were noted.   Trainer K Coetzee was advised that if he detects any abnormality with CLASSIC KING during the week, he would be expected to report back to the Panel of Stewards.  A post-race veterinary examination of CLASSIC KING revealed no obvious abnormality.

Mr. Lee Seng He – Senior Stipendiary Steward

Mr. Devaraj Arujunen – Stipendiary Steward

Mr. Jarry Chong Kok Heng – Stipendiary Steward

RACE 1 (R692)  CLASS 5 – 1100m(str) –  MAN OF HONOUR III 1977 HANDICAP

DYNAMIC TRIO, a course scratching as it had sustained a bruised off fore,  will be required to pass a veterinary examination before being declared to race again.

ALIEN (App AM Aizat) jumped away awkwardly and was slow into stride.

NAPOLEON (App S Saddam) jumped away awkwardly and bumped BASTION (S Salee).

FLYING NEKO (S Anandan) rolled out racing to the 250M, resulting in NAPOLEON having to steady and shift in to obtain clear running and shortly thereafter, NAPOLEON had to again steadied off the heels of FLYING NEKO and shifted out for a clear running.  Jockey S Anandan, the rider of FLYING NEKO was advised to exercise greater care under similar circumstances.

Prior to the ‘All Clear’, the Panel of Stewards reviewed the film of the start and observed that barrier 13 (PERCIUS) was slightly slow to open.  The Panel of Stewards were satisfied that PERCIUS (Y Aify) was not denied a fair start and was deemed a runner under MRA Rule 115.   The Starter was shown the vision of the start.

Jockey S Anandan, the rider of FLYING NEKO and App AM Aizat, the rider of ALIEN both reported that their mounts were not striding out freely.  Post-race veterinary examinations of FLYING NEKO and ALIEN revealed that both these geldings had returned broken-winded.  As such, they will each be required to pass a test (1000M/vet) before being declared to race again.

A post-race veterinary examination of TRAVERTINE (HS Gill) revealed no obvious abnormality.

The Panel of Stewards questioned Trainer P Lee, the trainer of EMPIRE BAY (App AK Lim) into the gelding’s apparent improved performance today.  Trainer P Lee stated that in his opinion, the gelding managed to get a good jump as compared to its previous start and the straight course today had contributed to its improved performance.  His explanation was noted.

The Club Veterinary Surgeon reported that REAL HERO (S Sandana) and TRAVERTINE returned having cast their off fore and near fore plates respectively.

PANEL OF STEWARDS’ INQUIRY INTO THE RIDING AND HANDLING OF “SUPREME STAR”, RIDDEN BY JOCKEY TM WAN IN RACE 3 (R633) CLASS 5 – 1200m(lc) – 1952 SPORTING GESTURE HANDICAP – PERAK MAY (GOLD VASE) MEETING 2018 –  SATURDAY – 19th MAY 2018.

The Panel of Stewards concluded an Inquiry on Thursday, 24th May 2018 into the riding and handling of SUPREME STAR.  Evidence were taken from Jockey TM Wan, the rider of SUPREME STAR and Trainer PK Leong, the trainer of SUPREME STAR.

After considering all the evidence and reviewing the videos, Jockey TM Wan, the rider of SUPREME STAR was found guilty of a charge under MRA Rule 44(8) as read with 44(8)(a) in that whilst riding SUPREME STAR in the above race, he failed to take all reasonable and permissible measures to ensure that SUPREME STAR was given full opportunity of winning or of obtaining the best possible placing.

The particulars of the charge are:

  1. He failed to give SUPREME STAR sufficient rein on jumping, resulting in the horse throwing its head up and losing ground.
  2. From shortly after the start, until about the 800M, he unnecessarily over-restrained SUPREME STAR and failed to let it stride out when it was reasonable to do so;
  3. From the 800M until entering the straight, he raced wide when it was reasonable and permissible to race closer to the rail;
  4. Inside the 400M, he shifted his body weight, resulting in SUPREME STAR becoming unbalanced.

When deciding on a penalty, the Panel of Stewards took into account the evidence of this case, Jockey TM Wan’s point of mitigation and his riding record.   Jockey TM Wan was disqualified for a period of eighteen (18) months with immediate effect from today, Thursday, 24th May 2018 and to expire on Saturday, 23rd November 2019, both dates inclusive.   In addition, he was also fined a sum of RM40,000/- (Malaysian Ringgit: Forty Thousand only.)   He was advised of his Right of Appeal (12.30pm).
