PENANG FEBRUARY/MARCH MEETING 2022
1ST DAY, SUNDAY, 27TH FEBRUARY 2022
RACE 1 (R264) CLASS 5(B) – 1200M
At about the 1100M-mark, MATILDA (J Low) shifted in, resulting in interference to DARCI SUPER (S Salee). At a subsequent Inquiry, Jockey J Low, pleaded guilty to a charge of careless riding under MRA Rule 44((9)(a)(ii) and was suspended for 2 (two) race days effective Monday, 28th February 2022 and to expire on Saturday, 12th March 2022, both days inclusive. He was informed of his Right of Appeal (1.35 pm).
Passing the 800M-mark, HEART FEELING was crowded and had to check when FUNKADELIC (App YY Oon) shifted inwards. At a subsequent Inquiry, App YY Oon, in the presence of his Employing Trainer, Mr B Ng, pleaded guilty to a charge of careless riding under MRA Rule 44((9)(a)(ii) and was suspended for 2 (two) race days effective Monday, 28th February 2022 and to expire on Saturday, 19th March 2022, both days inclusive. He was informed of his Right of Appeal (3.00 pm).
RACE 2 (R265) CLASS 5(A) – 1200M
At about the 700M-mark, PURE SPARK (App R Nuqman) was crowded and had to check when D’GREAT CHANCE (AM Aizat) shifted inwards. At a subsequent Inquiry, Jockey AM Aizat, the rider of D’GREAT CHANCE, pleaded guilty to a charge under MRA Rule 44(9)(a)(ii) for careless riding and was suspended from riding in races for a period of 2 (two) race days effective Monday, 28th February 2022 and to expire on Saturday, 19th March 2022, both days inclusive. He was informed of his Right of Appeal (2.00 pm).
DISQUALIFIED – App. AB Riduan
INQUIRY CONCERNING URINE SAMPLE CODED J-6393 WHICH WAS TAKEN FROM APP AB RIDUAN ON 29th JANUARY 2022 AT THE PENANG TURF CLUB JANUARY MEETING 2022 AND RETURNED POSITIVE TO “MITRAGYNINE” WHICH IS A PROHIBITED SUBSTANCE IN TERMS OF THE MRA RULES
The Stewards today (27th February 2022) concluded an Inquiry into the above matter. Evidence was taken from App AB Riduan in the presence of his Employing Trainer, Mr HY Cheng, Dr Chan Sue Hay, Chief Analyst of USains Biomics Laboratory and Mr Jason Tan from Usains Biomics Laboratory.
App AB Riduan pleaded guilty to a charge under MRA Rule 136(3)(b) and the particulars of the charge were that a urine sample coded J-6393, submitted by him on 29th January 2022 at the Penang Turf Club January Meeting 2022, upon analysis, revealed the presence of “Mitragynine”, which is a prohibited substance under the MRA Rules.
In deciding on penalty, the Stewards took into account his guilty plea, the nature and the seriousness of the prohibited substance and the fact that it is his second offence within 12 months for the same prohibited substance. App AB Riduan was disqualified for a period of one (1) year backdated to Saturday, 29th January 2022, which is the date when he was stood down from riding and to expire on Saturday, 28th January 2023, both days inclusive. He was informed of his Right of Appeal (10.50 am).
App AB Riduan was informed that he would be required to provide a clear urine sample for analysis before resuming riding.
App AB Riduan, in the presence of his Employing Trainer, Mr HY Cheng further pleaded guilty to 2 other charges under MRA Rule 152(3)(a) and MRA Rule 152(5)(a) in that at approximately 12.30 pm on 29th January 2022 at the designated urine collection area within the Penang Turf Club, he falsely informed the Stipendiary Steward on duty that he did not have anything concealed in his clothing when in fact and known to him, he had concealed in his under clothing a plastic bottle containing urine which he had brought with him with an intention to substitute the urine in the concealed plastic bottle for his urine sample that had been expressly requested for analysis. In so doing, App AB Riduan committed a breach of MRA Rule 152(3)(a) in that he had acted in a manner which in the opinion of the Stewards is prejudicial to the integrity, proper conduct or reputation of horse racing in Malaysia. App AB Riduan also committed a breach of MRA Rule 152(5)(a) in that he had misconducted himself on the race course.
In deciding on penalty, the Stewards took into account his guilty plea, the seriousness of the offence, and his mitigating factors. App AB Riduan was disqualified for a period of one (1) year for each offence, the penalties are to run concurrently. The disqualification will take effect from Sunday, 29th January 2023 and to expire on Sunday, 28th January 2024, both days inclusive. He was informed of his Right of Appeal (10.50 am).
