Jockey B Pinheiro (MILITARY FLAG) appeared before the Panel and was questioned regarding any factors, which in his opinion, contributed to the defeat of his horse and it performing below market expectations (RM7/-). He explained that after MILITARY FLAG’s last run where from a wide draw, he sat wide, showed pace and finished well, he was confident the horse could obtain an even better forward position today just behind the speed from its good draw. Jockey B Pinheiro explained that he was satisfied with his position in the run as the pace was fast, however, as the leaders had kicked clear, he commenced to ask MILITARY FLAG to build, however, he was unable to make ground on the leader, which in his opinion, was aided by today’s fast track. He further explained that in the concluding stages, after asking MILITARY FLAG to sustain a long run from the 600M, this horse had peaked on the run. He further stated that MILITARY FLAG may prefer further and a slightly slower run race, where it can relax early and easily get into a rhythm.

Trainer S Dunderdale was questioned regarding the performance of MILITARY FLAG. In this regard, he confirmed the statements of Jockey B Pinheiro with regards to the horse not appreciating the fast pace of today’s race and getting out of his ground in the middle stages particularly on a track, which in his opinion, was running fast and favouring horses that were in front. In his opinion, this was the reason why MILITARY FLAG was unable to make up ground as usual.

Trainer KC Tiang appeared before the Panel and was questioned regarding his instructions on PACIFIC EMPIRE. In this regard, he explained that his instructions to App R Nuqman were to race this horse with cover in a handy position as it was his view that this gelding failed to finish off its races when horses run passed it.

Trainer KC Tiang’s attention was drawn to the fact that in this horse’s last run and in its recent runs, it had been ridden to either hold the lead on the inside or pressure the pace from the outside. Additionally, it was further drawn to his attention that, the lack of intent from App R Nuqman, which coincided with his instructions, amounted to a deviation from the hold or pressure the lead tactics adopted in PACIFIC EMPIRE’s recent runs.  Consequently, Trainer KC Tiang was found guilty of a contravention of MRA Rule 35(8) and a penalty of RM1000/- was imposed.

6

LITTLE PONY

(App H Haikal)

Raced wide in the early stages. Hung inwards and shifted in away from the whip in the straight.

In the concluding stages, MOMENT OF JUSTICE had to ease sharply when awkwardly placed on the inside of MONTANA FLASH which shifted in away from the whip.

A race review was called into this incident, which was followed by an objection being lodged by Jockey B Pinheiro (MOMENT OF JUSTICE), the rider of the fourth placed horse against the third placed horse, MONTANA FLASH (Z Khairil) on the grounds of interference in the concluding stages. After considering the evidence in this matter, the Board upheld the objection. In arriving at this decision, the Board considered that in particular from the side-on angle, it was evident that at the point when the incident had occurred, MOMENT OF JUSTICE was about to definitively run passed MONTANA FLASH, however, this gelding shifted in causing MOMENT OF JUSTICE to ease and lose significant momentum and distance, which distance, was subsequently reduced again to 1.75 length at the finish when MOMENT OF JUSTICE was placed into clear running.

Consequently, the Board was satisfied that but for the above incident, MOMENT OF JUSTICE would have finished ahead of MONTANA FLASH, therefore it upheld the objection and amended the Judge’s result to read:

1st –  MAINSTREAM (App A Nazir)

2nd – NORDIC GEM (App M Lukman)

3rd – MOMENT OF JUSTICE (B Pinheiro)

4th – MONTANA FLASH (Z Khairil)

At the conclusion of an inquiry, Jockey Z Khairil, the rider of MONTANA FLASH, pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding MONTANA FLASH in this race, he failed to ensure that he did not cause interference to MOMENT OF JUSTICE in the concluding stages.

In assessing the penalty, the Stewards took into consideration Jockey Z Khairil’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of 1 (one) Selangor Turf Club race day with effect from 27 May 2024 and to expire on 2 June 2024, both dates inclusive.  In lieu of two (2) Selangor Turf Club race days, he was also fined RM3,000/.  He was advised of his Right of Appeal.

GENERAL REPORT(S) – SLTC

RACE 8 (R0492) CLASS 5A – 1020M (Track II), SATURDAY, 18 MAY 2024, SELANGOR TURF CLUB MAY MEETING 2024

The Stewards, on Sunday, 26 May 2024, inquired into App H Haikal’s riding of MAGIC HERO in the above race. Evidence was taken from App H Haikal, in the presence of his Trainer’s representative, Assistant Trainer Lai Jek Shen.

After considering the evidence and also reviewing the performance of MAGIC HERO, App H Haikal was charged under MRA Rule 44(10) for failing to ride to the satisfaction of the Stewards. The particulars of the charge being that in Race 8 run at the Selangor Turf Club on Saturday, 18 May 2024, he failed to ride MAGIC HERO to the satisfaction of the Stewards in that from the jump, he adopted an unreasonably tight hold which did not afford this gelding the best opportunity to obtain a good break. As a consequence of his actions, MAGIC HERO jumped awkwardly, threw its head up, lost ground and he became unbalanced for a short period, all of which prejudiced the gelding’s opportunity in the race.

App H Haikal pleaded not guilty to the charge, however, was found guilty as charged. In mitigation, the Stewards took into consideration App H Haikal’s riding record, mitigating factors and his submissions on penalty. He was suspended from riding in races for a period of two (2) months with effect from 27 May 2024 and to expire on 26 July 2024, both dates inclusive. He was also fined RM10,000/- and advised of his Right of Appeal.
